## FRAMASOFT’s Trademark Policy

This declaration complements the code of conduct.
If you comply with the code of conduct, you will probably not have to check
whether your actions conflict with this declaration.
However, if you need to use one of our brands, we encourage you to read it attentively.

### Introduction

FRAMASOFT is a non-profit organisation.
FRAMASOFT owns and oversees the trademarks for the names and logos of FRAMASOFT
as well as a other FRAMASOFT-related brands and softwares.

The softwares listed below are Free Software.
Their source code are available to download, modify and redistribute under a
Free Software license.
However, the software license does not cover the use of trademarks.
The proper use of FRAMASOFT trademarks is essential to inform users whether
or not the software stand behind products or services.

### Trademarks

FRAMASOFT owns the following trademarks in both word and logo form including
brands, slogans, styles:

- FRAMASOFT is a registered trademark in France under class 9, 16, 38, 41, 42 ; INPI number 4694656
- FRAMASOFT is a registered trademark in Europe under class 9, 16, 25, 35, 38, 41, 42 ; EUIPO number 3575587
- PEERTUBE is a registered trademark in France under class 9, 42 ; INPI number 4662501
- PEERTUBE is a registered trademark in Europe under class 9, 42 ; EUIPO number 018265042
- MOBILIZON is a registered trademark in France under class 9, 42, 45 ; INPI number 4662537
- MOBILIZON is a registered trademark in Europe under class 9, 42 ; EUIPO number 018265551

### Objectives

The objective of this trademark policy is to clarify proper usage of FRAMASOFT’s
trademarks by third parties to prevent misuse that can confuse users about
products and services from FRAMASOFT.
At the same time, this policy encourages individuals, organisations and businesses
to work with FRAMASOFT under the terms of this policy and the code of conduct.

### When you shouldn’t use FRAMASOFT’s trademarks

Here are a few examples that conflict with the way we use our brands,
and would lead us to use trademark law to regulate abuse.
But quite apart from the legal issue, it’s also a question of common sense:

- Use FRAMASOFT’s trademarks in a company or organisation name:
seriously, do you want to impersonate us?
- Use FRAMASOFT’s trademarks as name of a product or service: some companies
would be delighted, but it’s really not a good idea because it would mean
advertising on our behalf… and you wouldn’t want anyone to speak on your
behalf, right?
- Use FRAMASOFT’s trademarks in a domain name, with or without commercial purposes,
including social media: a domain name is also a mark of identity,
and if you use one of our brands as a domain name, you’re misleading users
into thinking that the site or service belongs to Framasoft.

### When you can use the FRAMASOFT’s trademarks without asking permission

But there are many cases where you can use our brands! And we even encourage such uses:

- Communicating facts about FRAMASOFT and it’s projects without suggesting
sponsorship or endorsement.
- Advertising your product or service relating to FRAMASOFT and it’s projects
in a way that is not misleading.
- Describing that your software is based on a FRAMASOFT’s Software code
or it is compatible with your product.
- Displaying FRAMASOFT’s trademarks on your own website solely as a hyperlink
to a FRAMASOFT’s website.

And of course, don’t hesitate to contact us if you have any doubts
or need specific permission. Our contact details are at the end of this statement.

### Finally, here are a few tips on how to use FRAMASOFT’s trademarks properly

- Use FRAMASOFT’s trademarks exact as shown. Any scaling must retain
the original proportions of the logo
(see [our branding style guide](https://framasoft.org/graphics/))
- Use FRAMASOFT’s trademarks only as an adjective, never as a noun or verb.
Example: Framasoft’s Peertube app.
- Wherever appropriate, include a trademark attribution notice.
It’s very simple, like this: “<Framasoft’s product> is a registered trademark
of the European Union.”
- Be careful not to suggest that any of our brands are affiliated with you
or any of your products or services.
Don’t forget that Framasoft is an independent organization.
- Sometimes our brands are usurped or used for slogans or advertising purposes,
suggesting that we endorse an action or service.

## Zásady používání ochranných známek společnosti FRAMESOFT

Toto prohlášení doplňuje kodex chování.
Pokud dodržujete kodex chování, pravděpodobně nebudete muset kontrolovat
zda vaše jednání není v rozporu s tímto prohlášením.
Pokud však potřebujete použít některou z našich značek, doporučujeme vám, abyste si ji pozorně přečetli.

### Úvod

FRMASOFT je nezisková organizace.
FRMASOFT vlastní a dohlíží na ochranné známky pro názvy a loga FRAMESOFT
stejně jako další značky a software související s FRMASOFT.

Software uvedený níže je svobodný software.
Jejich zdrojové kódy jsou k dispozici ke stažení, úpravě a redistribuci pod a
Licence svobodného softwaru.
Softwarová licence se však nevztahuje na používání ochranných známek.
Správné používání ochranných známek FRAMASOFT je nezbytné pro informování uživatelů, zda
nebo že software nestojí za produkty nebo službami.

### Ochranné známky

FRMASOFT vlastní následující ochranné známky ve formě slov a loga včetně
značky, slogany, styly:

- FRMASOFT je registrovaná ochranná známka ve Francii pod třídou 9, 16, 38, 41, 42; Číslo INPI 4694656
- FRMASOFT je registrovaná ochranná známka v Evropě pod třídou 9, 16, 25, 35, 38, 41, 42; Číslo EUIPO 3575587

### Cíle

Cílem těchto zásad používání ochranných známek je objasnit správné používání značek FRAMESOFT
ochranné známky třetími stranami, aby se zabránilo zneužití, které může uživatele zmást
produkty a služby společnosti FRAMASOFT.
Tato politika zároveň podporuje jednotlivce, organizace a podniky
spolupracovat s FRMASOFT v souladu s podmínkami této politiky a kodexu chování.

### Kdy byste neměli používat ochranné známky FRMASOFT

Zde je několik příkladů, které jsou v rozporu se způsobem, jakým používáme naše značky,
a vedlo by nás k používání zákona o ochranných známkách k regulaci zneužívání.
Ale zcela mimo právní otázku je to také otázka zdravého rozumu:

- Používejte ochranné známky FRAMASOFT v názvu společnosti nebo organizace:
vážně, chceš se za nás vydávat?
- Použijte ochranné známky FRAMASOFT jako název produktu nebo služby: některé společnosti
bylo by to potěšeno, ale opravdu to není dobrý nápad, protože by to znamenalo
inzerovat naším jménem... a nechtěli byste, aby někdo mluvil vaším jménem

- používat ochranné známky společnosti FRAMASOFT v názvu domény, s komerčními účely nebo bez nich,

### Kdy můžete používat ochranné známky společnosti FRMASOFT bez žádosti o povolení

Ale existuje mnoho případů, kdy můžete naše značky využít! A dokonce podporujeme taková použití:

- Sdělování faktů o FRMASOFT a jejích projektech bez navrhování
sponzorství nebo podpory.
- Inzerujte svůj produkt nebo službu týkající se společnosti FRAMASOFT a jejích projektů

At Framasoft, we don’t like (and don’t believe in) intellectual property.

But we live in a world that does, and need to protect ourselves and our work.

So we have registered some trademarks (PeerTube, Mobilizon, Framasoft…), and here is what we pledge.

### 1. We don’t plan to attack

Registering trademarks is a defensive move.
It’s to protect our work both from people who might otherwise register the
names we work hard to make known, and from those who would sully the names of
the projects we are building with our values, political stances and passion.

### 2. Don’t Panic

We will only use trademark law in last resort. We are not trademark trolls
looking forward to extorting money though legal violence.
We just want to protect the reputation of names we are working hard to make known.

We really intend to settle any problem we might have with you by talking it
out together.
If you act in good faith, there’s no need to panic.
We’re sure we will understand eachother and find an elegant solution.

### 3. Don’t fool people

If you say, or imply that you are us or that you are the “official one”,
we will use trademark law against you.
If we start getting messages of people who think your actions come from us,
we will contact you to talk and find a way to make it clear that you are you,
and we are us.

In our experience anyway, people are not fools, and honesty is a very powerful
way to bond with them.
We will use trademark law, in last resort and if needed, to protect this
relationship of trust and honesty we have built with people.

### 4. Don’t be an asshole

Really, it’s that simple.

Being assholy includes things that are forbidden by French law (promoting
Nazism and fascism, pedocriminality, endangering others, fake news…),
especially discrimination (against sex, gender, race, religion, orientation,
minorities… well, you know the drill…).

If you are using names of things we’ve worked hard for to be an asshole,
we will use trademark law against you.
If you try to push the limits, want to test, provoke and question society,
well good for you, but we don’t have time for this: don’t use our trademarks.
If you think there are too many rules, or that it’s too complicated not to be
an asshole: don’t use our trademarks.

If you fear you might be an asshole without knowing it, by ignorance even
though you try to keep yourself educated: you’ll be fine.

### 5. Let’s respect each other

If you’re not sure, come and talk with us. If we have a problem we’ll try to
come and talk to you first.

If by using the names of our projects, your actions start to soak up our time
and energy, if you’re giving us a bad name, we’ll definitely have a problem.
To avoid that, just remember that there are people who worked hard to give
the names you are using their honest reputation, and just respect that work.

If we find ourselves having to answer for your actions, we’ll need to talk.

When we talk together, if you’re trying to be a smart ass and negotiate every
word, if you don’t want to hear and consider our position (be assured we
always try to do the same with others), then we’ll probably settle our
disagreement using trademark law.

But we don’t want to, so let’s find a way to understand each other.
## Kodeks ponašanja

Mi u Framasoftu ne volimo (i ne vjerujemo u) intelektualno vlasništvo.

Ali živimo u svijetu koji u to vjeruje i moramo zaštititi sebe i naš rad.

Stoga smo registrirali neke zaštitne znakove (PeerTube, Mobilizon, Framasoft …), a za sljedeće se zalažemo.

### 1. Ne planiramo napadati

Registracija zaštitnih znakova je obrambeni potez.
To je zaštita našeg rada od ljudi koji bi inače mogli registrirati
imena za koja se trudimo učiniti poznatima, i od onih koji bi uprljali imena
projekte koje gradimo s našim vrijednostima, političkim stavovima i strašću.

### 2. Ne paničari

Zakon o zaštitnim znakovima koristit ćemo samo u krajnjem slučaju. Mi nismo trolovi zaštitnih znakova koji iznuđivaju novac pravnim putem.
Želimo samo zaštititi reputaciju imena za koja se trudimo da budu poznata.

Svaki problem po tom pitanju namjeravamo riješiti zajedničkim razgovorom.
Ako postupaš u dobroj namjeri, nema mjesta panici.
Sigurni smo da ćemo se razumjeti i da ćemo pronaći rješenje.

### 3. Nemoj zavaravati ljude

Ako kažeš ili impliciraš da si mi ili da si „službeni suradnik”,
upotrijebit ćemo zakon o zaštitnim znakovima protiv tebe.
Ako počnemo dobivati poruke od ljudi koji misle da tvoji postupci dolaze od nas,
kontaktirat ćemo te kako bismo porazgovarali i pronašli način da jasno damo do znanja da si ti ti,
a da smo mi mi.

U svakom slučaju, prema našem iskustvu ljudi nisu budale, a poštenje je vrlo moćan
način povezivanja s ljudima.
Zakon o zaštitnim znakovima ćemo koristiti u krajnjem slučaju i ako je potrebno, kako bismo to zaštitili
odnos povjerenja i poštenja koji smo izgradili s ljudima.

### 4. Ne budi seronja

Stvarno, tako je jednostavno.

Biti seronja uključuje stvari koje su zabranjene francuskim zakonom (promicanje
nacizma i fašizma, pedokriminalizam, ugrožavanje drugih, lažne vijesti …),
posebno diskriminacija (prema spolu, rodu, rasi, vjeri, orijentaciji,
manjine… znaš o čemu govorimo…).

Ako koristiš imena stvari za koje smo naporno radili,
upotrijebit ćemo zakon o zaštitnim znakovima protiv tebe.
Ako pokušaš pomaknuti granice, želiš testirati, provocirati i preispitati društvo,
dobro za tebe, ali za takve stvari nemamo vremena: nemoj koristiti naše zaštitne znakove.
Ako misliš da postoje previše pravila ili da je previše komplicirano da ne budeš
seronja: nemoj koristiti naše robne markzaštitne znakove.

Ako se bojiš da postaneš seronja a da toga nisi svjestan/svjestna, ili zbog neznanja
iako se trudiš biti obrazovan(a): sve će biti dobro.

### 5. Poštujmo jedni druge

Ako nisi siguran/sigurna, razgovaraj s nama. Ako imamo problem, najprije ćemo s tobom razgovarati.

We just want to protect the reputation of names we are working hard to make known.

We really intend to settle any problem we might have with you by talking it
out together.
If you act in good faith, there’s no need to panic.
We’re sure we will understand eachother and find an elegant solution.

### 3. Don’t fool people

If you say, or imply that you are us or that you are the “official one”,
we will use trademark law against you.
If we start getting messages of people who think your actions come from us,
we will contact you to talk and find a way to make it clear that you are you,
and we are us.

In our experience anyway, people are not fools, and honesty is a very powerful
way to bond with them.
We will use trademark law, in last resort and if needed, to protect this
relationship of trust and honesty we have built with people.

### 4. Don’t be an asshole

Really, it’s that simple.

Being assholy includes things that are forbidden by French law (promoting
Nazism and fascism, pedocriminality, endangering others, fake news…),
especially discrimination (against sex, gender, race, religion, orientation,
minorities… well, you know the drill…).

If you are using names of things we’ve worked hard for to be an asshole,
we will use trademark law against you.
If you try to push the limits, want to test, provoke and question society,
well good for you, but we don’t have time for this: don’t use our trademarks.
If you think there are too many rules, or that it’s too complicated not to be
an asshole: don’t use our trademarks.

If you fear you might be an asshole without knowing it, by ignorance even
though you try to keep yourself educated: you’ll be fine.

### 5. Let’s respect each other

If you’re not sure, come and talk with us. If we have a problem we’ll try to
come and talk to you first.

If by using the names of our projects, your actions start to soak up our time
and energy, if you’re giving us a bad name, we’ll definitely have a problem.
To avoid that, just remember that there are people who worked hard to give
the names you are using their honest reputation, and just respect that work.

If we find ourselves having to answer for your actions, we’ll need to talk.

When we talk together, if you’re trying to be a smart ass and negotiate every
word, if you don’t want to hear and consider our position (be assured we
always try to do the same with others), then we’ll probably settle our
disagreement using trademark law.

But we don’t want to, so let’s find a way to understand each other.

Ми у Framasoft-у не волимо (и не верујемо у) интелектуалну својину.

Међутим, живимо у свету који воли (и верује) у интелектуалну својину и треба да заштитимо себе и свој рад.


Тако да смо регистровали неке жигове („PeerTube“, „Mobilizon“, „Framasoft“…) и ево за шта се обавезујемо.

### 1. Не планирамо да нападамо

Регистровање жигова је одбрамбени потез.
То је да заштитимо наш рад и од људи који би иначе могли да региструју
називе за која се трудимо да их направимо познатим и заштитимо од оних који би упрљали називе
пројеката које градимо нашим вредностима, политичким ставовима и страшћу.

### 2. Не паничите

Закон о жиговима ћемо користити само у крајњој инстанци. Ми нисмо тролови жигова који се радују изнуђивању новца правним насиљем.
Желимо само да заштитимо репутацију имена на којима се трудимо да објавимо. Заиста намеравамо да решимо сваки проблем који бисмо могли да имамо са вама тако што ћемо о њему
заједно разговарати.
Ако поступате у доброј намери, нема потребе за паником.
Сигурни смо да ћемо се разумети и пронаћи елегантно решење.

### 3. Не заваравајте људе

Ако кажете, или имплицирате да сте ви ми или да сте ви „званични“,
користићемо закон о жиговима против Вас.
Ако почнемо да добијамо поруке људи који мисле да ваше акције потичу од нас,
контактираћемо Вас да разговарамо и пронађемо начин да јасно ставимо до знања да сте Ви - Ви, а ми - ми.

У сваком случају, према нашем искуству, људи нису будале, а искреност је веома моћан начин

да се повежете са њима.
Користићемо закон о жиговима, у крајњем случају и ако је потребно, да заштитимо овај
однос поверења и поштења који смо изградили са људима.

### 4. Не будите „сероње“

Заиста, то је тако једноставно

Бити „сероња“ укључује ствари које су забрањене француским законом (промовисање
нацизма и фашизма, педокриминалност, угрожавање других, лажне вести...),
посебно дискриминацију (против пола, расе, вере, оријентације,
мањина... па, знате шта...).

Ако користите називе ствари за које смо напорно радили да бисте били „сероња“, ми ћемо користити закон о жиговима против Вас.
Ако покушавате да померите границе, желите да тестирате, провоцирате и доводите у питање друштво,
добро за Вас, али ми немамо времена за ово: не користите наше жигове.
Ако мислите да има превише правила или да је превише компликовано да не будете
„сероња“: не користите наше жигове.

Ако се плашите да бисте могли бити „сероња“, а да тог незнања нисте ни свесни, иако покушавате да се образујете: бићете добро.

### 5. Поштујмо једни друге

Ако нисте сигурни, дођите и разговарајте са нама. Ако будемо имали проблема, покушаћемо
прво да дођемо и разговарамо са Вама.

Ако коришћењем назива наших пројеката ваше акције почну да упијају наше време
и енергију, ако нам дате лошу репутацију, сигурно ћемо имати проблем.
Да бисте то избегли, само запамтите да постоје људи који су напорно радили да дају
називе које користите, као и њихову поштену репутацију и само поштујте тај рад.

Ако будемо морали да одговарамо за Ваше поступке, мораћемо да разговарамо.

Када разговарамо заједно, ако покушавате да се „правите паметни“ и преговарате о свакој речи, ако не желите да чујете и размотрите наш став (будите сигурни да увек покушавамо да урадимо исто са другима), онда ћемо вероватно да решимо наше несугласице коришћењем закона о жиговима.

Али не желимо, па хајде да нађемо начин да се разумемо.

This declaration complements the code of conduct.
If you comply with the code of conduct, you will probably not have to check
whether your actions conflict with this declaration.
However, if you need to use one of our brands, we encourage you to read it attentively.

### Introduction

FRAMASOFT is a non-profit organisation.
FRAMASOFT owns and oversees the trademarks for the names and logos of FRAMASOFT
as well as a other FRAMASOFT-related brands and softwares.

The softwares listed below are Free Software.
Their source code are available to download, modify and redistribute under a
Free Software license.
However, the software license does not cover the use of trademarks.
The proper use of FRAMASOFT trademarks is essential to inform users whether
or not the software stand behind products or services.

### Trademarks

FRAMASOFT owns the following trademarks in both word and logo form including
brands, slogans, styles:

- FRAMASOFT is a registered trademark in France under class 9, 16, 38, 41, 42 ; INPI number 4694656
- FRAMASOFT is a registered trademark in Europe under class 9, 16, 25, 35, 38, 41, 42 ; EUIPO number 3575587
- PEERTUBE is a registered trademark in France under class 9, 42 ; INPI number 4662501

### Objectives

The objective of this trademark policy is to clarify proper usage of FRAMASOFT’s
trademarks by third parties to prevent misuse that can confuse users about
products and services from FRAMASOFT.
At the same time, this policy encourages individuals, organisations and businesses
to work with FRAMASOFT under the terms of this policy and the code of conduct.

### When you shouldn’t use FRAMASOFT’s trademarks

Here are a few examples that conflict with the way we use our brands,
and would lead us to use trademark law to regulate abuse.
But quite apart from the legal issue, it’s also a question of common sense:

- Use FRAMASOFT’s trademarks in a company or organisation name:
seriously, do you want to impersonate us?
- Use FRAMASOFT’s trademarks as name of a product or service: some companies
would be delighted, but it’s really not a good idea because it would mean
advertising on our behalf… and you wouldn’t want anyone to speak on your
behalf, right?
- Use FRAMASOFT’s trademarks in a domain name, with or without commercial purposes,
including social media: a domain name is also a mark of identity,
and if you use one of our brands as a domain name, you’re misleading users
into thinking that the site or service belongs to Framasoft.

### When you can use the FRAMASOFT’s trademarks without asking permission

But there are many cases where you can use our brands! And we even encourage such uses:

- Communicating facts about FRAMASOFT and it’s projects without suggesting
sponsorship or endorsement.
- Advertising your product or service relating to FRAMASOFT and it’s projects
in a way that is not misleading.
- Describing that your software is based on a FRAMASOFT’s Software code
or it is compatible with your product.
- Displaying FRAMASOFT’s trademarks on your own website solely as a hyperlink
to a FRAMASOFT’s website.

And of course, don’t hesitate to contact us if you have any doubts

### Finally, here are a few tips on how to use FRAMASOFT’s trademarks properly

- Use FRAMASOFT’s trademarks exact as shown. Any scaling must retain

- Utiliser les marques de FRAMASOFT dans un nom de domaine, à des fins commerciales
ou non, y compris sur les médias sociaux : un nom de domaine est aussi
une marque d’identité, et si vous utilisez une de nos marques comme nom de domaine,
vous induisez les utilisateurs en erreur en leur faisant croire que le site
ou le service appartient à Framasoft.

### Quand peut-on utiliser les marques de FRAMASOFT sans en demander l’autorisation ?

Mais il existe de nombreux cas où vous pouvez utiliser nos marques !
Nous encourageons même ce type d’utilisation :

- Communiquer des faits sur FRAMASOFT et ses projets sans suggérer
un parrainage ou une approbation.
- Faire la publicité de votre produit ou service en rapport avec FRAMASOFT
et ses projets d’une manière qui n’est pas trompeuse.
- Décrire que votre logiciel est basé sur le code d’un logiciel de FRAMASOFT

- Veillez à ne pas suggérer que l’une de nos marques est affiliée à vous
ou à l’un de vos produits ou services. N’oubliez pas que Framasoft
est une organisation indépendante.
- Il arrive que nos marques soient usurpées ou utilisées à des fins de slogans
ou de publicité, laissant penser que nous cautionnons une action ou un service.
