This declaration complements the code of conduct. If you comply with the code of conduct, you will probably not have to check whether your actions conflict with this declaration. At the same time, this policy encourages individuals, organisations and businesses to work with FRAMASOFT under the terms of this policy and the code of conduct. ### When you shouldn’t use FRAMASOFT’s trademarks Here are a few examples that conflict with the way we use our brands, and would lead us to use trademark law to regulate abuse. ## Code of conduct
At Framasoft, we don’t like (and don’t believe in) intellectual property. But we live in a world that does, and need to protect ourselves and our work. So we have registered some trademarks (PeerTube, Mobilizon, Framasoft…), and here is what we pledge. ### 1. We don’t plan to attack Registering trademarks is a defensive move. It’s to protect our work both from people who might otherwise register the names we work hard to make known, and from those who would sully the names of the projects we are building with our values, political stances and passion. ### 2. Don’t Panic We will only use trademark law in last resort. We are not trademark trolls looking forward to extorting money though legal violence. We just want to protect the reputation of names we are working hard to make known. We really intend to settle any problem we might have with you by talking it out together. If you act in good faith, there’s no need to panic. We’re sure we will understand eachother and find an elegant solution. ### 3. Don’t fool people If you say, or imply that you are us or that you are the “official one”, we will use trademark law against you. If we start getting messages of people who think your actions come from us, we will contact you to talk and find a way to make it clear that you are you, and we are us. In our experience anyway, people are not fools, and honesty is a very powerful way to bond with them. We will use trademark law, in last resort and if needed, to protect this relationship of trust and honesty we have built with people. ### 4. Don’t be an asshole Really, it’s that simple. Being assholy includes things that are forbidden by French law (promoting Nazism and fascism, pedocriminality, endangering others, fake news…), especially discrimination (against sex, gender, race, religion, orientation, minorities… well, you know the drill…). If you are using names of things we’ve worked hard for to be an asshole, we will use trademark law against you. If you try to push the limits, want to test, provoke and question society, well good for you, but we don’t have time for this: don’t use our trademarks. If you think there are too many rules, or that it’s too complicated not to be an asshole: don’t use our trademarks. If you fear you might be an asshole without knowing it, by ignorance even though you try to keep yourself educated: you’ll be fine. ### 5. Let’s respect each other If you’re not sure, come and talk with us. If we have a problem we’ll try to come and talk to you first. If by using the names of our projects, your actions start to soak up our time and energy, if you’re giving us a bad name, we’ll definitely have a problem. To avoid that, just remember that there are people who worked hard to give the names you are using their honest reputation, and just respect that work. If we find ourselves having to answer for your actions, we’ll need to talk. When we talk together, if you’re trying to be a smart ass and negotiate every word, if you don’t want to hear and consider our position (be assured we always try to do the same with others), then we’ll probably settle our disagreement using trademark law. But we don’t want to, so let’s find a way to understand each other.
## Code de conduite
Chez Framasoft, nous n’aimons pas (et ne croyons pas en) la propriété intellectuelle. Mais nous vivons dans un monde qui y croit, et nous devons nous protéger, nous et notre travail. Nous avons donc déposé quelques marques (PeerTube, Mobilizon, Framasoft…), et voici ce que nous nous engageons à faire. ### 1. Nous ne prévoyons pas d’attaquer L’enregistrement des marques est, pour nous, une démarche défensive. Il s’agit de protéger notre travail à la fois contre ceux qui pourraient enregistrer les noms de projets que nous nous efforçons de faire connaître, et contre ceux qui voudraient salir les projets que nous construisons avec nos valeurs, nos positions politiques et notre passion. ### 2. Ne paniquez pas ! Nous n’utiliserons le droit des marques qu’en dernier recours. Nous ne sommes pas des *trolls de marques* cherchant à extorquer de l’argent par la violence juridique. Nous voulons simplement protéger la réputation des projets que nous nous efforçons de faire connaître. Notre intention première est de régler par la discussion les éventuels problèmes que nous pourrions avoir sur l’abus d’utilisation d’une marque. Si vous êtes de bonne foi, il n’y a pas lieu de paniquer. Nous sommes sûrs que nous nous comprendrons et que nous trouverons une issue intelligente et courtoise au problème. ### 3. Ne trompez pas les gens Si vous dites ou laissez entendre que vous êtes Framasoft ou que vous êtes « le projet officiel », nous utiliserons le droit des marques contre vous. Si nous commençons à recevoir des messages de personnes qui pensent que vos actions viennent de nous, nous vous contacterons pour discuter et trouver un moyen de faire comprendre que vous c’est vous et que nous, c’est nous. D’après notre expérience, les gens ne sont pas dupes, et l’honnêteté est un moyen très puissant de créer du lien avec elles et eux. Nous utiliserons le droit des marques, en dernier recours et si nécessaire, pour protéger cette relation de confiance et d’honnêteté que nous avons construite au fil du temps avec les gens. ### 4. Ne soyez pas un troud’cul Vraiment, c’est aussi simple que cela. Être un troud’cul inclut des choses qui sont interdites par la loi française (promotion du nazisme et du fascisme, pédocriminalité, mise en danger d’autrui, fake news…), mais aussi la discrimination (contre le sexe, le genre, la race, la religion, l’orientation, les minorités… enfin, vous connaissez la chanson…). Si vous jouez aux troud’culs en utilisant le nom de projets sur lesquels nous avons travaillé dur, nous utiliserons le droit des marques contre vous. Si vous essayez de repousser les limites, si vous voulez tester, provoquer et remettre en question la société, tant mieux pour vous, mais nous n’avons pas le temps pour cela : n’utilisez pas nos marques. Si vous pensez qu’il y a trop de règles, ou que c’est trop compliqué de ne pas être un troud’cul : n’utilisez pas nos marques. Si vous craignez d’être un troud’cul sans le savoir, par ignorance ou si vous essayez de vous éduquer : tout ira bien. ### 5. Respectons-nous mutuellement Si vous n’êtes pas sûr, si vous avez un doute, venez en parler avec nous. Si nous avons un problème, nous essaierons de venir vous parler d’abord. Si en utilisant les noms de nos projets, vos actions commencent à pomper notre temps et notre énergie. Si vous nous donnez une mauvaise réputation, nous aurons certainement un problème. Pour éviter cela, rappelez-vous qu’il y a des gens qui ont travaillé dur pour donner une bonne réputation aux noms que vous utilisez, et respectez simplement ce travail. Si nous nous retrouvons à devoir répondre de vos actions, nous devrons avoir une sérieuse discussion. Lorsque nous discuterons, si vous essayez de faire le malin et de négocier chaque mot, si vous ne voulez pas entendre et prendre en considération nos positions (soyez assuré que nous essayons toujours de faire de même avec les autres), alors nous réglerons probablement notre désaccord en utilisant le droit des marques.
